This Privacy Statement discloses the privacy policy (this “Policy”) for the Services and describes how Forcura, LLC (“Forcura”), the operator of the Services, collects, protects, and uses information we receive from visitors to and users of the Services. This Policy has been created in order to inform and demonstrate to you our firm commitment to privacy and to outline how we deal with any personal data you provide while using the Services. If you do not agree with any portion of this Policy, you should not use the Services.

This Policy applies only to information collected through the Services and not to information collected offline or through any other websites (even if affiliated with Forcura or linked to by the Services). Forcura affiliates and subsidiaries may have their own subdomains and websites that may not be subject to this Policy. Forcura business partners, ad networks, and other third parties have their own websites and privacy practices. We encourage you to read the privacy notices of all websites you visit to understand their privacy practices and your options. Any password-protected areas of the Services may be subject to additional terms or agreements with us.

2. The Information We Collect and How We Use Your Information

There are two kinds of information that websites can obtain about you: (A) Anonymous Information and (B) Personally Identifiable Information.

(A) Anonymous Information: “Anonymous Information” is data in a form that does not permit direct association with any specific individual. Anonymous Information is aggregate data that websites use to administer their sites. This Anonymous Information comprises information that cannot be used to identify or contact you. Forcura may from time to time retain third parties to help us collect and aggregate information from the Services.

(B) Personally Identifiable Information: “Personally Identifiable Information” is any information about a natural person who is either identified or who can be identified from data and other information either in our possession or likely to come into our possession, such as your name, email address, or your telephone number. Similarly, to the extent that anonymous information is combined with Personally Identifiable Information, we treat the combined information as Personally Identifiable Information.

We collect information from you and any devices (including mobile devices) both when you provide it voluntarily and also automatically when you use the Services. We may also collect Personally Identifiable Information from other sources, as described below.

In addition, we also collect Personally Identifiable Information about you from third parties in connection with the Services, including from the following sources:

Account Registration Information

Registering for an account is an optional service provided by the Site. You do not have to register to browse this Site. You must register for an account to access the services offered at https://www.myforcura.com/.

This is the Personally Identifiable Information that is provided by you or collected by us to enable you to login and access your account and the Services. This includes your name and email address and may include your business address and phone number.

Some of the Personally Identifiable Information we will ask you to provide is required in order to create your account.

  • To provide you with information or services that you request from us. 

  • To notify you about changes to the Services or any products or services we offer or provide through it.

  • To create, maintain and personalize your experience with the Services.

Website Inquiries or Scheduling Demos

Contained in the Services are links or forms that can be used to contact Forcura via the Services so you can comment, request a demo, make a complaint, make suggestions, and ask questions. Your email address is required on this form, as well as your name and company name. Forcura may put information from email on file, but does not currently share, sell, license, or transmit this information with third parties without express authorization from you.

Newsletters and Other Communications

We may offer visitors to the Services the opportunity to sign up to receive updates or other email communications from the Services, or to share the Site with others. In order to sign up for these communications, we ask for contact information, such as name, organization, and email address. We also may offer the opportunity for you to receive mailings that we think may be of interest to you.

Social Media Platforms

If you choose to access, visit, and/or use any of our pages on social media platforms such as Facebook, Twitter, Instagram, or LinkedIn (“Social Media Platforms”), we may receive aggregate information and analysis about visitors’ usage of our pages on such Social Media Platforms. You may choose to provide Personally Identifiable Information through Social Media Platforms, including without limitation your name, phone number, or address when you communicate with us on the Social Media Platforms, post suggestions or comments for us, or through other such interactions on the Social Media Platforms.

Usage Information

This can be Personally Identifiable Information and non-Personally Identifiable Information that is collected about you when you are using the Services, and this may include:

  • Information about your interactions with the Services, which includes the date and time of any information you enter into the Services and your interactions with other users of the Services.
  • Technical data which may include URL information, cookie data, web beacons and other tracking technology information, your IP address, the types of devices you are using to access or connect to the Services, unique device IDs, device attributes, network connection type (e.g., WiFi, 3G, LTE, Bluetooth) and provider, network and device performance, browser type, language, and operating system. The Services use cookies, unique identifiers and similar technologies to collect information over time and across different websites when you use or visit the Services. We or our third-party partners use common tracking tools to collect information about the pages you view, our website functions that you access, the buttons and icons you click, and to remember your login information and website settings to make it easier and more efficient for you to use the Services, and to provide advertising content that we think may be of interest to you.

Cookies. Cookies are small data files that are downloaded onto your computer or mobile device when you use the Services, which are unique to your device or account.   Cookies make it easier for you to use the Services by saving your preferences so that we can use these to improve your next and subsequent visits to the Services – for example, remembering your session, application settings, and configuration choices. Pixels, Web Beacons. We or third party partners may use invisible pixels or beacons on the Services to count how many users access or use certain pages, features or content. This information is collected and reported in the aggregate. 3. Sharing Your Information

We share non-Personally Identifiable Information with third parties at our discretion. In connection with the Services, we may share your Personally Identifiable Information with certain third parties who we engage to help us run our business and perform the services, including under the following circumstances:

  • Software and service providers we use to manage and process your information, for example, providers of payment processing software.
  • Web analytics providers who monitor and analyze the use of the Services.
  • Marketing service providers we use to communicate with you.
  • Hosting providers that provide database storage for our business.
  • Other third parties that you expressly request us to share your Personally Identifiable Information with.

We do not sell Personally Identifiable Information.

Additionally, we will share your Personally Identifiable Information with third parties where required by law, where it is necessary in connection with the Services, or where we have another legitimate interest in doing so.

Most of the third parties with whom we share your Personally Identifiable Information are located and store your information in the United States, although some may be located or store your information outside of the United States. These third parties are only permitted to use your Personally Identifiable Information to the extent necessary to enable them to provide their services to us and are required to follow our express instructions and to comply with appropriate security measures to protect your Personally Identifiable Information.

If we are subject to a merger or acquisition with/by another company, we may share information with the other company in connection with the transaction and your Personally Identifiable Information may be transferred to such company upon the completion. Such acquiring company’s right to use your data shall be limited to the terms of this Policy unless additional notice is provided to you.

4. Your Rights and Choices Regarding Your Information

Marketing Preferences. We support the right of visitors to choose. You will be given the right to opt-out of receiving any promotional materials about Forcura or its partners whenever you are asked to provide Personally Identifiable Information on the Services. If you do not opt-out at that time, but later decide that you do not wish to receive future communications of this nature, you can contact us as set forth under “How to Contact Us ” above, indicating that you no longer want to receive information relating to the Services. Please allow sufficient time for your preferences to be processed. Even if you opt-out of receiving marketing messages, we may still contact you for transactional purposes like confirming or following up on an order or service request or asking you to review a service you have ordered. If you later opt back into getting marketing communications from us, we will remove your information from our opt-out databases.

As noted above in “The Information We Collect, ” you can choose whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable cookies, your experience with the Services may be impaired and some features may not work as they were intended.

Additionally, Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the preferences or settings page of your web browser. However, these features are not yet uniform, so we do not currently respond to such features or signals. Therefore, if you select or turn on a “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Policy.

You can choose to limit the data that third party services share with us using the options provided to you by the applicable third party service (for example, the options provided by a third party social media platform when you connect your social media account with our Services). You can also disconnect your use of the Services from the third-party service at any time using the options provided to you by the applicable third-party service. Please note, however, that if you disconnect from the third-party service, that will not delete the data we may have previously collected while you were connected.

Special Notice to California Residents:

Under the California Civil Code, residents of the State of California that have provided any Personally Identifiable Information to Forcura have the right to request a list of all third parties to which Forcura has disclosed Personally Identifiable Information during the preceding year for direct marketing purposes. Alternatively, the law provides that if Forcura has a privacy policy that gives either an opt-out or opt-in choice for use of Personally Identifiable Information by third parties (such as advertisers or affiliated companies) for marketing purposes, Forcura may instead provide you with information on how to exercise your disclosure choice options free of charge. Forcura qualifies for the alternative option and has adopted a policy of not disclosing the Personally Identifiable Information of customers to third parties for the third parties' direct marketing purposes if the customer has exercised an option that prevents that information from being disclosed to third parties for those purposes. It has established this Policy that provides you with details on how you may either opt-out of the use of your Personally Identifiable Information by third parties for direct marketing purposes. If you are a California resident and would like to request information about how to exercise your third-party disclosure choices, please send a request to legal@forcura.com with a preference on how our response to your request should be sent.

5. Security

Security of information communicated by or to us over the Internet is of utmost concern to us; however, no data transmission over the Internet can be guaranteed to be 100% secure. The Services incorporates reasonable safeguards to protect the security, integrity, and privacy of the Personally Identifiable Information we have collected. We have put in place reasonable precautions to protect information from loss, misuse, and alteration, including Secure Socket Layer (SSL) technology and database encryption for the Services. Please do not use email to communicate information to us that you consider confidential. While we strive to protect your Personally Identifiable information, Forcura cannot ensure or warrant the security of any information you transmit to us or through the Services.

6. Retention

Forcura will retain your Personally Identifiable Information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.

We may also retain Usage Information for internal analysis purposes. Usage Information is generally retained for a shorter period of time, except when Usage Information is used to strengthen the security or to improve the functionality of the Services, or we are legally obligated to retain Usage Information for longer periods.

7. Children’s Privacy

The Children's Online Privacy and Protection Act of 1998 (“COPPA”) defines a “Child” (or “Children” as used herein) as anyone under the age of 13. Forcura strictly adheres to COPPA. For that reason, we do not collect or maintain information obtained through the Services from those we actually know are under 13, and no part of the Services are structured to attract anyone under 13. By using the Services, you represent that you are at least 13 years old. If you do not meet this age requirement, then you must not access or use the Services.

If you are a parent or guardian and you are aware that your Child has provided us with Personally Identifiable Information, please contact us though one of the methods listed under “How to Contact Us ”, above. If we become aware that we have collected Personally Identifiable Information from Children without verification of parental consent, we take reasonable steps to remove that information from our servers.

8. External Links

The Services may provide links to various websites that we do not control. When you click on one of these links, you will be transferred out of the Services and connected to the website of the organization or company that you selected. Each of these linked sites maintains its own independent privacy and data-collection policies and procedures. While Forcura expects its partners and affiliates to respect the privacy of our users, Forcura cannot be responsible for the actions of third parties. If you visit a website that the Services links to, we encourage you to consult that website's privacy policy before providing any Personally Identifiable Information and whenever interacting with any website.

9. Consent and Modifications to Policy

The Services are controlled, operated, and administered entirely within the United States. By using the Services, you signify your agreement to the terms of this Policy. If you do not agree with this Policy, please do not disclose any Personally Identifiable Information through the Services. This Policy and the use of the Services are governed by Florida law. Any claim related to the Services or this Policy shall be brought in a federal or state court in Jacksonville, Florida, within one year after the claim arises. Users of the Services consent to the sole and exclusive jurisdiction and venue of such courts as the most convenient and appropriate for the resolution of disputes concerning this Policy. This Policy and the notices outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any third party.

10. Modifications to Privacy Policy

Forcura may modify this Policy at any time, in its discretion, and modifications are effective upon being posted on the Services. We will announce any material changes to this Privacy Policy through an alert on the Services and/or via email.
