This Privacy Notice (this “Notice”) discloses the privacy policy for the Services and describes how Forcura, as operator of the Services, collects, protects, and uses information we receive from visitors to and users of the Services. This Notice has been created in order to inform and demonstrate to you our firm commitment to privacy and to outline how we deal with any Personal Information (defined below) you provide while using the Services. If you do not agree with any portion of this Notice, you should not use the Services. 

This Notice applies only to information collected through the Services and not to information collected through any other websites (even if affiliated with Forcura or linked in the Services). Forcura affiliates and subsidiaries may have their own subdomains and websites that may not be subject to this Notice. Forcura business partners, ad networks, and other third parties have their own websites and privacy practices. 2. The Information We Collect and How We Use Your Information

There are two kinds of information that we may collect and process about you when you visit or use the Services: (1) Anonymous Information and (2) Personal Information.

Anonymous Information” is data in a form that does not permit direct association with any specific individual. Anonymous Information is aggregate data used to administer the Services. Anonymous Information comprises information that cannot be used to identify or contact you. Forcura may from time to time retain third parties to help us collect and aggregate Anonymous Information from the Services.

Personal Information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household, such as name, email address, telephone number, or Sensitive Personal Information (defined below).

Sensitive Personal Information” (or “SPII”) is Personal Information that reveals:

  • Social Security number, driver’s license, state identification card or passport number;
  • Account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
  • Your precise geolocation;
  • Your racial or ethnic origin, religious or philosophical believes, or union membership; or
  • The contents of your mail, email, or text messages, unless the business is the intended recipient of the communication.

 

Personal Information does not include:

  • de-identified or aggregated information;
  • information that is lawfully made available from federal, state, or local government records, or information that Forcura has a reasonable basis to believe is lawfully made available to the general public by the consumer or from widely distributed media; or information made available by a person to whom the consumer has disclosed the information if the consumer has not restricted the information to a specific audience; and
  • information excluded from the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”), collectively referred to herein as “California Consumer Privacy Laws”, such as health or medical information covered under the Health Insurance Portability and Accountability Act of 1996, medical information governed by the California Confidentiality of Medical Information Act, personal information disclosed pursuant to the Driver’s Privacy Protection Act of 1994, and financial information covered under the Fair Credit Reporting Act or Gramm-Leach Bliley Act.

We do not attempt to re-identify any de-identified information we may collect or process. To the extent that Anonymous Information is combined with Personal Information, we treat the combined information as Personal Information.

We collect information from you and any devices (including mobile devices) both when you provide it voluntarily and also automatically when you use the Services.

In addition, we also collect Personal Information about you from third parties in connection with the Services, including from the following sources:

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Forcura’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Forcura about our users is among the assets transferred.

  • For any other purpose disclosed by us when you provide the information.

We may also disclose your Personal Information to third parties where required by any court order, law, or legal process, including a response for a government or regulatory request, where it is necessary in connection with the Services, including to enforce or apply our terms of use and other agreements, or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our customers, or others.

Most of the third parties with whom we share your Personal Information are located and store your information in the United States, although some may be located or store your information outside of the United States. These third parties are only permitted to use your Personal Information to the extent necessary to enable them to provide their services to us and are required to follow our express instructions and to comply with appropriate security measures to protect your Personal Information.

We may disclose Anonymous Information with third parties at our discretion.

 

 

 

 

5. Your Rights and Choices Regarding Your Information

Marketing Preferences. We support the right of visitors to choose. You will be given the right to opt out of receiving any promotional materials about Forcura or its partners whenever you are asked to provide Personal Information on the Services. If you do not opt-out at that time, but later decide that you do not wish to receive future communications of this nature, you can contact us as set forth under “How to Contact Us” above, indicating that you no longer want to receive information relating to the Services. Please allow sufficient time for your preferences to be processed. Even if you opt out of receiving marketing messages, we may still contact you for transactional purposes like confirming or following up on an order or service request or asking you to review a service you have ordered. If you later opt back into getting marketing communications from us, we will remove your information from our opt-out databases.

As noted above in “The Information We Collect and How We Use Your Information”, you can choose whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable cookies, your experience with the Services may be impaired and some features may not work as they were intended.

Additionally, Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the preferences or settings page of your web browser. However, these features are not yet uniform, so we do not currently respond to such features or signals. Therefore, if you select or turn on a “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Notice.

You can choose to limit the data that third party services share with us using the options provided to you by the applicable third party service (for example, the options provided by a third party social media platform when you connect your social media account with our Services). You can also disconnect your use of the Services from the third-party service at any time using the options provided to you by the applicable third-party service. Please note, however, that if you disconnect from the third-party service, that will not delete the data we may have previously collected while you were connected.

 

 

 

 

 

6. California Consumer Privacy Laws Rights

Depending on where you live, you may have certain rights with respect to Personal Information that we have collected and used under certain circumstances, including the below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

Right to Know. You can request that we provide you the following information regarding our use of your Personal Information:

      • The purposes for which we have collected or used such Personal Information
      • The categories of sources for the Personal Information we have collected about you
      • The categories of third parties with whom we have disclosed your Personal Information
      • If we have disclosed your Personal Information for a business purpose, a list identifying the Personal Information categories that each category of recipient obtained
      • If we have sold your Personal Information, a list identifying the Personal Information categories that each category of recipient purchased

Right to Access. You can request that we provide you a copy of your Personal Information that we have collected in the past 12 months.

Right to Correction. You can request that we correct any inaccuracies in your Personal Information. Forcura will use commercially reasonable efforts to correct the identified inaccurate information upon receiving a verifiable request.

Right to Deletion. You can request that we delete your Personal Information collected in the past 12 months when we no longer need such data in connection with our Services (subject to certain exceptions that may apply under applicable law). 

Right to Opt Out of Sale or Sharing. Under California Consumer Privacy Law, you may opt out of the sale or the disclosing of your Personal Information for purposes of cross-context behavioral advertising (“sharing”). We do not sell your Personal Information. You can make a request to opt out of sharing of your Personal Information by visiting Your California Privacy Choices.

Right to Non-Discrimination. If you choose to exercise your privacy rights under the California Consumer Privacy Laws we will not charge you different prices or provide different quality of services unless those differences are related to your Personal Information or otherwise permitted by law.

Only persons who currently lives in California, or are domiciled in California but are outside of the state for a temporary or transitory purpose (“California Residents”), or an agent legally authorized to act on a California Resident’s behalf, may make an actionable, verifiable consumer request related to Personal Information (“California Consumer Request”). Please understand that we are required to verify your California Consumer Request and may require you to provide some information to enable us to carry out such verification. We will deny requests from agents that do not submit proof of legal authorization to act on your behalf. To verify that an agent has legal authority to act for you, we may require a copy of a power of attorney or require that you provide the agent with written permission and verify your own identity with us. We cannot respond to your California Consumer Request or provide you with Personal Information if we cannot verify your identity or authority to make the California Consumer Request and confirm the Personal Information relates to you.

When you, or someone legally authorized to act on your behalf, make a California Consumer Request, you can expect the following:

  • We will verify your identity. You will need to provide us with certain information so that we can verify that you are who you say you are. Which information is required may depend on the type and sensitivity of information subject to the California Consumer Request.

  • We will respond to your California Consumer Request within the legally required amount of time. If necessary, we may need additional time to respond where allowed by law, but we will reply either way within the legally required period and, if we need an extension, we will explain why.

  • In certain cases, a California Consumer Request may be denied. For example, if we cannot verify your identity or if providing you information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your California Consumer Request, we will explain why we denied it.

  • Making a California Consumer Request does not require you to create an account with us. We will only use Personal Information provided in a California Consumer Request to verify the requestor’s identity or authority to make the California Consumer Request.


Additionally, under the California Civil Code, California Residents have the right to ask us one time each year if we have shared Personal Information with third parties for their direct marketing purposes and the identities of any such third parties. Alternatively, the law provides that if Forcura has a privacy policy that gives either an opt-out or opt-in choice for use of Personal Information by third parties (such as advertisers or affiliated companies) for marketing purposes, Forcura may instead provide you with information on how to exercise your disclosure choice options free of charge. Forcura qualifies for the alternative option and has adopted a policy of not disclosing the Personal Information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option that prevents that information from being disclosed to third parties for those purposes. It has established this Notice that provides you with details on how you may either opt-out of the use of your Personal Information by third parties for direct marketing purposes. 7. Security

Security of information communicated by or to us over the Internet is of utmost concern to us; however, no data transmission over the Internet can be guaranteed to be 100% secure. The Services incorporates reasonable safeguards to protect the security, integrity, and privacy of the Personal Information we have collected. We have put in place reasonable precautions to protect information from loss, misuse, and alteration, including Secure Socket Layer (SSL) technology and database encryption for the Services. Please do not use email to communicate information to us that you consider confidential. While we strive to protect your Personal Information, Forcura cannot ensure or warrant the security of any information you transmit to us or through the Services.

 

 

 

 

8. Retention

We store personal information about you on computer systems operated by us or our service providers. We keep various records that contain Personal Information in accordance with applicable state and federal regulations, or pursuant to contractual obligations. In general, we aim to keep Personal Information only for as long as necessary and only for the reason(s) we collected it. It may be necessary to keep Personal Information longer than our official retention periods for legal or regulatory reasons, including litigation.

We consider the following criteria when determining how long a particular record will be retained, including any personal information contained in that record:

  • How long the record is needed to provide you with the Services you request.
  • How long the record is needed to support and enhance our operational processes.
  • How long the record is needed to protect our rights and legal interests.
  • How long the record must be retained to comply with applicable laws and regulations.

The same personal information about you may be included in more than one record and used for more than one purpose, each of which may be subject to different retention periods based on the factors listed above.

 

 

 

 

9. Children’s Privacy

The Children’s Online Privacy and Protection Act of 1998 (“COPPA”) defines a “Child” (or “Children” as used herein) as anyone under the age of 13. Forcura strictly adheres to COPPA. For that reason, we do not collect or maintain information obtained through the Services from those we actually know are under 13, and no part of the Services are structured to attract anyone under 13. By using the Services, you represent that you are at least 13 years old. If you do not meet this age requirement, then you must not access or use the Services.

If you are a parent or guardian and you are aware that your Child has provided us with Personal Information, please contact us though one of the methods listed under “How to Contact Us” above. If we become aware that we have collected Personal Information from Children without verification of parental consent, we take reasonable steps to remove that information from our servers.

While Forcura expects its partners and affiliates to respect the privacy of our users, Forcura cannot be responsible for the actions of third parties. 11. Consent and Modifications to Notice

The Services are controlled, operated, and administered entirely within the United States. By using the Services, you signify your agreement to the terms of this Notice. If you do not agree with this Notice, please do not disclose any Personal Information through the Services. This Notice and the use of the Services are governed by Florida law. Any claim related to the Services or this Notice shall be brought in a federal or state court in Jacksonville, Florida, within one year after the claim arises. Users of the Services consent to the sole and exclusive jurisdiction and venue of such courts as the most convenient and appropriate for the resolution of disputes concerning this Notice. This Notice and the notices outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any third party.

Forcura may modify this Notice at any time, in its discretion, and modifications are effective upon being posted on the Services. We will announce any material changes to this Privacy Policy through an alert on the Services and/or via email.
